Computer Viruses

  • While every effort is made to ensure that all information provided at the Site does not contain computer viruses, you should take reasonable and appropriate precautions to scan for computer viruses and should ensure that you have a complete and current backup of the applicable items of information contained on your computer system. You should pay specific attention to some of the newer viruses that have been written to automatically execute when an infected word processing document is loaded into certain word processing programs.

Conformance with Law

  • You agree that your use of the Site shall not violate any applicable local, national or international law, including but not limited to any regulations having the force of law. Some jurisdictions may have restrictions on the use of the Internet by their residents.
  • You agree not to impersonate another person in your use of the Site or the sending of any e-mail to an address listed on the Site.

Choice of Law

  • The laws of the Province of Ontario and the laws of Canada applicable therein shall govern as to the interpretation, validity and effect of this agreement, notwithstanding any conflict of laws provisions or your domicile, residence of physical location. You hereby consent and submit to the non-exclusive of the courts of the Province of Ontario in any action or proceeding instituted or related to this agreement.

Submissions

  • All information submitted to the Owner via the Site shall be deemed and remain the property of the Owner and the Owner shall be free to use, for any purpose, any ideas, concepts, know-how or other techniques contained in information provided to the Owner through the Site or sent through e-mail. Owner shall not be subject to any obligations of confidentiality regarding any such information submitted to it unless specifically agreed by the Owner or required by law.
  • You agree that any information submitted for inclusion at the Site does not infringe on the intellectual property or other rights of any third parties and you grant the Owner a right to provide access to the information from the Site. You warrant that any software submitted to the Owner shall be free of computer viruses.

Privacy Policy

ParkSmart Inc. and its affiliates (“ParkSmart”) respect your right to privacy, and take the steps to ensure that your right to privacy under the Personal Information and Protection of Electronic Documents Act (“PIPEDA”) is protected. Private personal information can be information such as your name, home address, telephone number, e-mail address and financial information (such as credit card information). You may provide us with your Personal Information when you: contact us to discuss the payment of municipal parking tickets, pay and display machine parking charges or monthly parking permits by credit card or cheque. The purpose of this Privacy Policy is to inform you about why we collect Personal Information, and to provide you with contact information should you have any questions or concerns about our Personal Information protection practices.

Why does ParkSmart collect Personal Information?

ParkSmart may collect, use, and disclose your Personal Information to third parties to carry out the activities described below:

  • Credit card, cheque payments for parking privilege fees and parking ticket payments;
  • Responding to your requests for service regarding payment transactions;
  • Providing you with information regarding your SmartCity® smart card, our pay and display parking equipment, or providing you with a replacement SmartCity® smart card where necessary or the transactions related to the use of your SmartCity® smart card;
  • Completing service transactions with you related to issuance and payment of monthly parking permits and payments for these permits.

Limiting our use and disclosure of your Personal Information

By choosing to provide your Personal Information to ParkSmart, you are consenting to its continued use and disclosure in accordance with the principles outlined in this Privacy Policy. If you prefer that we do not use or disclose your Personal Information for any or all of these purposes, you may notify us of your wishes at any time, subject to any legal or contractual restrictions and requirements, by contacting us as indicated below. A notification that we not use or disclose your Personal Information for particular purposes may affect our ability to provide you with the products and services described above.

Personal Client Information Security

As part of ParkSmart’s privacy policy related to customer information for credit/debit/cheque information we receive and driver’s license information we obtain we limit access to this Personal Information about you to our specific employees who need to know the information to provide the products and services to you. We maintain physical, electronic and procedural safeguards on this type of Personal Information.

Our disclosure of your Personal Information to Third Parties

ParkSmart does not sell, trade in, barter or exchange for consideration any Personal Information it has obtained. ParkSmart will only provide Personal Information to third parties if such Personal Information is used solely for the purposes of providing services to ParkSmart which enable it to provide products and services to you.
